1. Suing the Buyers or Builder is not going to be fruitful and will grossly be Time & Money consuming.2. Instead re-negotiate with the Builder for fresh terms & conditions and other benefits. Typically the builder would also be expecting this, since any delay would cause him losses, due to lack of your signatures of all relevant documentations. There is nothing wrong in the argument which is in favour of the Builder to go for the construction on the terrace you can make only objections in case the terms of the agreement has not been fulfilled by the builders and there is any contravention in in part of the Builder to complete the construction and the floor has been raised in in contravention to the agreement. Further agreement in respect of changed law is not entered between yourself and your builder. Thus, you can prevent the builder from selling apartments on 5th floor. Why is there no 13 floor in buildings?

Panel from an elevator in a residential apartment building in Shanghai, Floors 4, 13 and 14 are missing, because of the similarity between the pronunciation of the word “four” and “death” in Chinese. The thirteenth floor is a designation of a level of a multi-level building that is often omitted in countries where the number 13 is considered unlucky,

Omitting the 13th floor may take a variety of forms; the most common include denoting what would otherwise be considered the thirteenth floor as level 14, giving the thirteenth floor an alternate designation such as “12A” or “M” (the thirteenth letter of the Latin alphabet ), or closing the 13th floor to public occupancy or access (e.g., by designating it as a mechanical floor ).

Reasons for omitting a thirteenth floor include triskaidekaphobia on the part of the building’s owner or builder, or a desire by the building owner or landlord to prevent problems that may arise with superstitious tenants, occupants, or customers. In 2002, based on an internal review of records, Dilip Rangnekar of Otis Elevators estimated that 85% of the buildings with Otis brand elevators did not have a floor named the 13th floor.

Early tall-building designers, fearing a fire on the 13th floor, or fearing tenants’ superstitions about the rumor, decided to omit having a 13th floor listed on their elevator numbering. This practice became commonplace, and eventually found its way into American mainstream culture and building design.

Vancouver city planners have banned the practice of skipping 4s and 13s, since it could lead to mistakes by first responders, for example going to the wrong floor.

Are builder floors legal in Delhi?

The Difference Between Builder Floor and Apartment – Many people do not fully understand what a builder floor apartment is, and how it is different from residential flats that one can purchase via a developer in housing societies. The difference between the two is vast, and it is vital that, as a property owner, you fully understand it and then make an informed decision.

Ownership – When it comes to traditional flats or apartments, the property agreement only states that the buyer is only the specific residential unit owner. On the other hand, in a builder flat, the agreement between the landowner/developer may state that the floor buyer is also a part-owner of the plot.

The property may be offered to the buyer on a lease basis, making it a leasehold agreement. Contrary to a popular myth, there is nothing illegal about independent builder floors. The buyer and seller have to register the property in the sub-registrar’s office like any other apartment.

  • Read: All You Need to Know About Banglarbhumi 2022 Freedom & Independence – Another essential difference between a standard apartment and a builder floor is that having an entire floor provides more freedom and privacy to the buyer.
  • Since any CHS-like legal body does not bind a builder floor apartment, the owner has more freedom to make use of and build the space as they wish to.

Maintenance – One of the disadvantages of a builder floor is that the cost of maintenance, repairs, and upgradation depends entirely on the buyer. In a cooperative housing society, these costs are lower as they are shared amongst different flat owners.

Amenities – While there is no limit on how many amenities a builder floor owner can have, it is generally observed that amenities such as a typical gymnasium, swimming pool, community hall, garden for children and senior citizens are absent in an independent builder floor flat. On the other hand, such amenities are standard in prominent residential societies, especially in urban cities such as Mumbai, Pune, Delhi, Bangalore, etc.

Thus, the buyer must be ready to weigh both the options before buying. Read: The Ins and Outs of Purchasing Your First House with Section 80EE

Is 5th floor allowed in East Delhi?

How Many Floor Construction Is Allowed In Delhi Representational Image (File Photo) NEW DELHI: The East Delhi Municipal Corporation (EDMC) has introduced a policy that will allow owners of top floors of residential buildings to obtain sanction for construction on terraces without having to involve owners of other floors, Mayor Shyam Sunder Aggarwal said on Wednesday, December 15, 2021.

This is part of the EDMC’s policy on floor-wise sanction and regularisation of the existing floors in residential buildings, in both regular and unauthorised regularised colonies, for the benefit of the general public, he said. Aggarwal said the step was taken as the EDMC received a number of complaints regarding blackmailing of owners of top floors of buildings by owners of lower floors or “demands for money” being made by the latter.

He said in regular and unauthorised regularised colonies, the right of ownership of the terrace remains with the resident of the top floor of a building. Earlier, if the top floor owner wanted to construct a fresh floor, then he or she had to produce a No-Objection Certificate (NOC) from the owners of the lower floors to get the building plan sanctioned by the municipality.

This led to malpractices, he added. “We had received several complaints in this regard. Now as per the new policy, the owner of the top floor of a residential building can obtain the sanction for the building plan for construction on terrace within the permissible height of 15 metres. There will be no need for signature or NOC from owners of lower floors,” Aggrawal said.

However, the services of lower floor owners shall not be disturbed, he added. EDMC’s new policy to benefit general public The scheme is a part of EDMC’s policy on floor-wise sanction and regularisation of the existing floors in residential buildings, in both regular and unauthorised regularised colonies, for the benefit of the general public.

Can we build duplex on 2nd floor?

Understanding Duplex Houses: All You Need To Know What is the meaning of a duplex home? A duplex house is strictly a house with two floors. In case there are three or more floors, the house will be known as a Triplex or a multiplex. There are duplex houses that have two single floors side by side.

Duplex houses in India often have one kitchen and dining room only. The concept of a Duplex house is, however, slightly different in Europe and America where there are two houses side by side with separate entrances and separated by a wall. This makes each house independent with its own kitchen and the second one is often rented.

Duplex House Plan- the duplex house is a single individual house with two floors and is often occupied by a single-family. There is a staircase within the house for going to the upper floor. There are also duplex homes in India where the upper floor has a separate staircase outside and has a separate kitchen so that the upper floor can be given on rent.

  1. Background Information- How Duplexes Became Popular The word Duplex comes from the Latin word meaning two houses.
  2. The earliest record of duplexes is found in Minneapolis, USA where the Melin family built two houses one on top of the other.
  3. Andrew and Sarah were Swedish immigrants who met and married in Illinois and came to settle in Iowa with their seven children.

Later, Andrew left the family to settle with another Swedish woman. Sarah was left alone with the seven children and they all moved to Minneapolis. In a bid to keep the family together, Sarah built their first home in 1904 and called it a duplex. The entire Melin family occupied this novel concept of a duplex.

  • Gradually this concept became popular as people realised they could keep ageing parents as well as growing children on a separate individual floor where they could have their privacy and still be close.
  • The concept spread around the world in no time and today Duplex houses are the most popular mode of housing in India after apartments.
  • Difference between two-storey House and Duplex

The main difference between a two-storey house and a Duplex is that a duplex is a complete home and is designed for one family with one kitchen. A two-storey house in India can accommodate two or more families and will often have two or more kitchens and at least two bathrooms.

  1. There are instances where larger joint families in India and small groups live separately in independent units within the same house.
  2. Two-storey houses are often designed for accommodating two or more independent units within the same house.
  3. Difference between Duplex and a Villa A Villa is a much more luxurious house with a garden, gymnasium, swimming pool and can have more than two floors.

The term villa has its origin in Roman times and denoted summer homes in the countryside for rich and famous citizens. Villas have high walls and considerable privacy. Duplex houses are not so big and do not come with swimming pools and gymnasiums. Duplex houses in India have a small lawn in front and a small kitchen garden at the back.

  1. A smaller room can be converted into a small gym.
  2. But essentially, a duplex is for a single medium-sized family only.
  3. Difference between a Duplex and a Penthouse The difference between a Duplex and a penthouse is very pronounced.
  4. A penthouse is housed on the top floor of either an apartment block or a large building.

A penthouse is a luxurious independent house and can also have a gymnasium and a medium-sized swimming pool. A penthouse often occupies the entire top floor as an independent house. Many penthouses have more than one floor and there are staircases within the house.

  1. A Duplex, on the other hand, is strictly two floors and is not as luxurious as a penthouse.
  2. What is Better: Duplex or Flat Flats are easier to maintain, sell or give out on rent.
  3. A Duplex is a bigger house and it is difficult to even give out a part of it on rent as most duplexes have one kitchen only.

Maintenance and upkeep costs are higher in a duplex house. A cost comparison would reveal one can get two small flats at the same cost as a duplex. It would be convenient to live in one flat and give the other out on rent. On the flip side, duplexes are also being redesigned in India as two separate floors with a staircase outside the house and individual kitchen and dining rooms on each floor.

  • In the end, it is your choice and you can always make the Duplex the way you want it to be.
  • The duplex should be in a good locality and not near slums or landfill areas which become an eyesore.
  • Risks involved in investing in a duplex.
  • There are considerable risks involved in investing in a duplex.
  • A duplex is often bought as a choice for better, higher and spacious living.

But there may not be good returns from it. It is advisable to buy a duplex house in a locality where duplexes are preferred as a mode of housing. In India, most housing complexes have a majority of flats and apartments and a small percentage of the campus land is set aside for duplexes, executive floors and villas.

There are risks involved in selling a duplex as there are limited buyers for duplexes. If the Duplex is built in an upmarket locality, there will be buyers willing to invest in a duplex. The locality is important. Is it difficult to find buyers for a duplex home? It is difficult but not impossible to find buyers for the duplex property.

There is a section of people who prefer duplex property. Duplex property is a unique kind of house that has its own following. There are people who wouldn’t live in any other kind of housing. But there are conditions and it is necessary to know the psychology of the people who like and prefer duplex property.

  1. Such people like a self-contained house and an exclusive atmosphere.
  2. The self-contained house they are looking for includes a portico, parking space, big comfortable rooms, spacious balconies and a good view.
  3. Hence it is necessary for duplex apartments to be in a good clean locality.
  4. Open drains, slums in the vicinity, overcrowding of houses are deterrents that will not attract prospective buyers.

Buyers are also careful about the safety factor and would prefer to buy a duplex within a gated complex with its security guards. Duplex homes give their owners some exclusivity and privacy. People looking for these advantages will always prefer a Duplex over an apartment.

What is the cost of building a duplex in India? The approximate cost of a duplex house in India on a 2000 Sq. Ft plot of land would vary from ₹35 to 50 lakhs in a smart city but would go up to ₹70-80 lakhs in a metropolitan city. This would be a duplex with parking space, small front and back gardens, at least three bedrooms, two bathrooms, two balconies and a small room on the roof.

The actual building cost of such a duplex would be between ₹20 to ₹25 lakhs. This cost is less than that of bigger 3 or 4 BHK apartments and is a complete house in itself. Are duplexes common in India? Yes. Duplex homes are quite common in India. Especially among the upper-middle class.

  3. The present shortage of housing based on the present statistics of 3 housing units built per 1000 people against the requirement of 5 per 1000 people has led to a present shortfall of 10 million units.

An additional 25 million housing units are needed to be made by 2030 to meet this housing shortfall in the residential sector. The last boom in the housing industry had come in 2009 with a stimulus package from the western world. Another such stimulus package is expected in 2022 and this is very likely to bring in a big boom in the housing sector.

Earlier rules limited construction to a stilt and three floors within a prescribed height of 15 metres. The new provision has been made in the revised Haryana building code 2017, and comes in the backdrop of a rising demand for houses in urban areas. “This is to benefit the people in a big way. The new HUDA building norms mean now the residents have the option to reconstruct their old houses as well,” said Yashpal Yadav, administrator at HUDA.
